How do you apply for a residence permit?

When you come as a foreign national to the Netherlands, it is important that you have a residence permit. This is proof that you are legally residing in The Netherlands.

If you want to stay in The Netherlands for more than 3 months, you must apply for a residence permit by the Access and Stay procedure (TEV). After a positive mark of the VA, you have permission to enter The Netherlands. You can collect your residence permit from the Immigration and Naturalization Service (IND).

Conditions for applying for a residence permit

Certain period of time

• You must have a valid MVV that matches the purpose of stay for which you are applying for a residence permit
• You must have a valid passport
• You or the person you are going to stay, must have sufficient means
• You must be prepared to cooperate in a medical examination of diseases that are indicated in the infectious disease law
• You are not allowed to perform work for an employer without having complied with the ‘Foreign Labor Law’
• You may not have provided or withhold any incorrect information that has previously led to a rejection of a granted residence permit or visa
• You may not have stayed illegal in The Netherlands. With the exception that the foreign national qualifies for family reunification, minor and is single or is a victim of trading in human beings.

Undetermined time

• Have been in possession of a residence permit for a definite period of time for 5 years
• Meets the conditions for a residence permit for a definite period of time
• Is registered in the Basic Registration of Persons (BRP) of your place of residence or municipality. The IND checks this.
• You are in possession of a valid residence permit until the moment that the IND takes a decision on the application
• You have an independent, sufficient and sustainable income
• You have obtained the civic integration certificate, or you have an exemption for this
